Announcement on Promulgation and Abolition of Some Commodities Classification Decisions(General Administration of Customs Announcement [2017] No. 46)


The General Administration of Customs promulgated the Announcement on Promulgation and Abolition of Some Commodities Classification Decisions on 30 September 2017, and has decided to announce the Year 2017 Commodities Classification Decision(Ⅲ)with some already promulgated Commodities Classification Decisions(Ⅲ)abolished, pursuant to the relevant provisions of the Administrative Provisions of the PRC Customs on Commodities Classification of Imports and Exports (General Administration of Customs Order No. 158). Some commodities classification decisions shall also be repealed due to change in the laws and administrative regulations on which they are based. The aforesaid classification decisions shall be implemented with effect from 1 October 2017.

Announcement on the Clarification of Matters Related to the Direct Supply Business of Bonded Oil Products across Customs Areas(General Administration of Customs Announcement [2017] No. 47)


The Announcement on the Clarification of Matters Related to the Direct Supply Business of Bonded Oil Products across Customs areas issued by the General Administration of Customs on 9 October 2017, and determined to further strengthen the actual customs supervision on the direct supply business of bonded oil products across customs areas, and to regulate the business operations of enterprises involved in the direct supply business of bonded oil products across customs areas. The Announcement has carried on detailed provisions on matters related to the direct supply business of bonded oil products across customs areas and shall be implemented with effect from 9 October 2017.

Announcement on the Standardization of Customs Transit Business(General Administration of Customs Announcement [2017] No. 48)


The General Administration of Customs issued the Announcement on the Standardization of Customs Transit Business on 11 October 2017 with decision to further standardize the customs transit business. The Announcement has set out the following circumstances under which customs transit declaration is acceptable: multiple-model through transportation cargos, import and export goods with a through bill of lading for transhipment; imported solid wastes satisfying certain criteria and approved by customs offices; import and export goods susceptible to natural factors such as temperature, static electricity, dust etc. and unsuitable for inspection within the customs surveillance area, which meet certain criteria and have been approved by  the competent customs offices (customs at the point of arrival for imported goods and customs at the place of dispatch for exported goods); together with mails, express mails, temporary import and export goods (including items under ATA Carnet), transit goods, cargos carried and transported by Sino-Europe trains, exported goods by way of market procurement, import and export commodities by retail in cross-border E-commerce, duty-free items and articles for official or personal use provided to foreign diplomatic and resident offices and the staff thereof. The Announcement shall be implemented with effect from 1 January 2018.

Announcement on the HS Code Application Requirements Related to the Anti-dumping Against Copolymer Polyoxymethylene  (General Administration of Customs Announcement [2017] No. 49)


The General Administration of Customs promulgated the Announcement on the HS code Application Requirements Related to the Anti-dumping Against Copolymer Polyoxymethylene on 19 October 2017. The Customs Tariff Commission of the State Council determined to collect anti-dumping duties on imported Copolymer Polyoxymethylene native to South Korea, Thailand and Malaysia (Tariff code: 3907.1010 and 3907.1090) for a period of 5 years since 24 October 2017. Therefore, The Ministry of Commerce has issued the Announcement [2017] No. 61 which has clarified the specific scope of products against which anti-dumping measures will be implemented. For application of the imported products within the anti-dumping scope under the aforesaid HS code, consignees shall fill the tariff code column with 39071010.1and 39071090.10 commencing on 24 October 2017.

Announcement of the General Administration of Customs on the Application Requirements for HS Code Related to the Anti-dumping and Counter-veiling Against Imports of  O-Chloro-p-nitroaniline(General Administration of Customs Announcement [2017] No. 50)


The General Administration of Customs promulgated the Announcement of the General Administration of Customs on the Application Requirements for HS Code Related to the Anti-dumping and Counter-veiling  Against Imports of  o-chloro-p-nitroaniline on 19 October 2017. China conducted provisional anti-dumping and counter-veiling measures in the fashion of collecting deposit on imported o-chloro-p-nitroaniline native to India (Tariff code: 2921.4200) from 20 October 2017. Therefore, the Ministry of Commerce promulgated the Announcement [2017] No. 56 and No. 57, and explicated the specific scope of products subject to the provisional anti-dumping and counter-veiling measures. The consignee of imports shall fill the application column with tariff code of 29214200.20 when applying for imported products within the scope subject to provisional anti-dumping and counter-veiling measures under the aforesaid Tariff Code from 20 October 2017. Upon the decision made by the Customs Tariff Commission of the State Council to collect anti-dumping and counter-veiling duties on imported o-chloro-p-nitroaniline native to India , the consignee of imports also shall fill the application column with tariff code of 29214200.20 when applying for imported products within the scope subject to provisional anti-dumping and counter-veiling measures under the tariff code of 2921.4200 during the implementation period of tax measures.

Announcement on the Adjustment of the Supervision Period for Imports Eligible for Reduction or Exemption of Customs Duties(General Administration of Customs Announcement [2017] No. 51)


The General Administration of Customs Released the Announcement on the Adjustment of the Supervision period for Imports Eligible for Reduction or Exemption of Customs Duties on 24 October 2017, determining to adjust the supervision period for imports eligible for reduction or exemption of customs duties. The Announcement prescribes that the supervision period for ships and aircraft-related imports eligible for reduction or exemption of customs duties shall be 8 years and that for motor vehicles and other goods shall be 6 years and 3 years respectively. The term of customs supervision shall commence on the date of clearance. The Announcement shall take effect from the date of promulgation.

Announcement on the Releasing of Specifications for Setting Up Customs-supervised Work Premises(General Administration of Customs Announcement [2017] No. 52)


The General Administration of Customs issued the Announcement on the Releasing of Specifications for Setting Up Customs-supervised Work Premises on 30 October 2017. The Specifications for Setting Up Customs-supervised Work Premises was made by the General Administration of Customs in accordance with relevant provisions of the Provisional Measures on Administration of Customs Control Premises of the People’s Republic of China (General Administration of Customs Order No. 232). The Specification stipulates that customs-supervised premises involved in the operation of waterway transport, airway transport, railway transport, highway transport, express delivery and storage tank and enterprises operating metering stations of cross-border energy pipelines in China shall going through relevant administrative permits formalities in accordance with the Provisional Measures on Administration of Customs Control Premises of the People’s Republic of China and the relevant requirements on matters of administrative permits under General Administration of Customs Announcement [2017] No. 37. The Announcement shall be implemented with effect from 1 November 2017.

Notice of the Customs Tariff Commission of the State Council on Offering Zero Tariff Treatment for 97% Tariff Items to the Republic of the Gambia and the Democratic Republic of Sao Tome and Principe (Shui Wei Hui [2017] No. 22)


The Customs Tariff Commission of the State Council released the Announcement on Offering Zero Tariff Treatment for 97% Tariff Items to the Republic of the Gambia and the Democratic Republic of Sao Tome and Principe on 27 October 2017, with notice to implement tariff free treatment for 97% tariff items to the Republic of the Gambia and the Democratic Republic of Sao Tome and Principe as the least developed countries from 1 December 2017. The catalogue of 97% tariff items enjoying tariff-free treatment shall be implemented in accordance with the Appendix 5 of the Notice of Customs Tariff of the State Council on 2017 Tariff Adjustment Scheme (Shui Wei Hui [2016] No. 31).

Announcement of the General Administration of Quality Supervision and the General Administration of Customs on the Adjustment of Catalogue of Entry-Exit Commodities Subject to Inspection and Quarantine by the Entry-Exit Inspection and Quarantine Authorities (General Administration of Quality Supervision & General Administration of Customs Announcement [2017] No. 93)


The General Administration of Quality Supervision and the General Administration of Customs issued the Announcement on the Adjustment of Catalogue of Entry-Exit Commodities Subject to Inspection and Quarantine by the Entry-Exit Inspection and Quarantine Authorities on 31 October 2017, deciding to make some adjustment to the Catalogue by cancelling item “A” of customs supervision and management requirements for 158 customs products codes in relation to industrial products and 4 customs products codes related to tobacco. The Announcement also specifies no more entry inspection and quarantine supervision but only exit inspection and quarantine supervision shall be conducted by the inspection and quarantine authorities. The aforesaid adjustments take effect from 1 November 2017.

Announcement of the General Administration of Quality Supervision on the Issuance of Certificates of Origin for Ceramic tile exported to Pakistan (General Administration of Quality Supervision, Inspection and Quarantine of the PRC Announcement [2017] No. 87)


The General Administration of Quality Supervision promulgated on 26 October 2017 the Announcement on the Issuance of Certificates of Origin for glazed tiles exported to Pakistan, notifying ceramic title manufacturing enterprises and export enterprises having made written commitment to the General Administration of Quality Supervision (hereinafter referred to as “enterprises within the list”) to file application with the General Administration of Quality Supervision for corresponding  certificates of origin in accordance with their written commitments from the date of promulgation of this notice. Manufacturing enterprises and export enterprises involving in ceramic title exportation of the same batch are all included in the list. The General Administration of Quality Supervision shall not accept the application for general certificate of origin made by enterprises against their written commitments, and shall degrade their credit rating in accordance with requirements related to the credit management of entry-exit inspection and quarantine.

Announcement of the General Administration of Quality Supervision on Cancellation of Quantity Inspection Requirements for Imported Timber (General Administration of Quality Supervision, Inspection and Quarantine of the PRC Announcement [2017] No. 92)


The General Administration of Quality Supervision released the Announcement on Cancellation of Quantity Inspection Requirements for Imported Timber on 30 October 2017, determining to cancel the quantity inspection requirements for imported timber and no more quantity inspection on imported timber shall be conducted by the quality supervision, inspection and quarantine departments. The Announcement takes effect as of the date of promulgation.

MOFCOM Announcement on Releasing the Application Conditions, Application Procedures and Distributing Principles of Export Quota of Phosphate Ore in 2018(Ministry of Commerce Announcement  [2017] No. 64)


In accordance with the relevant provisions specified in Foreign Trade Law of the People's Republic of China, Regulation of the People's Republic of China on the Administration of the Import and Export of Goods and Measures for the Administration of License for the Export of Goods, the Ministry of Commerce released on 23 October 2017 the Application Conditions, Application Procedures and Distributing Principles of Export Quota of Phosphate Ore in 2018.

MOFCOM Announcement on Releasing the Total Export Tariff Quotas of Industrial and Agricultural Products in 2018(Ministry of Commerce Announcement [2017] No. 68)


Pursuant to the Foreign Trade Law of the People’s Republic of China, the Regulation of the People's Republic of China on the Administration of the Import and Export of Goods and relevant rules and regulations, MOFCOM promulgated on 30 October 2017 the Total Export Tariff Quotas of Industrial and Agricultural Products in 2018. The Ministry of Commerce accepts application for exported quota (excluding those allocated through bid invitation) from 1 to 15 November 2017. Any quota applicant meeting specific conditions can file application with the commerce administration departments or ministries of commerce of various provinces, autonomous regions and centrally-administered municipalities, municipalities with independent planning status and the Production and Construction Corps of Xinjiang Uygur Autonomous Region. The application conditions and procedures relating to the export quota of licorice and licorice products, rush mat and rush mat products and other products allocated through bid invitation will be published in addition.

MOFCOM Announcement on Releasing the Total Import Amount, Distribution Rules and Relevant Procedures of Tariff Quotas of Chemical Fertilizer in 2018(Ministry of Commerce Announcement [2017] No. 69)


In accordance with the Regulation of the People's Republic of China on the Administration of the Import and Export of Goods as well as Interim Measures for the Administration of Import Tariff Quotas of Chemical Fertilizer, MOFCOM released on 30 October 2017 the Total Import Amount, Distribution Principle and Relevant Procedures of Tariff Quotas of Chemical Fertilizer in 2018, which stipulates the total imported tariff quotas of chemical fertilizer in 2018 to be 13.65 million tons, including 3.3 million tons of carbamide, 6.9 million tons of diammonium phosphate and 3.45 million tons of compound fertilizer.

Decision of the State Food and Drug Administration on Adjustment of Matters Relating to Registration and Administration of Imported Pharmaceuticals (State Food and Drug Administration Order No. 35)


The State Food and Drug Administration promulgated the Decision on Adjustment of Matters Relating to Registration and Administration of Imported Pharmaceuticals on 10 October 2017, which has been passed by the bureau session of the State Food and Drug Administration on 20 June 2017. The Decision simplifies the registration and administration of imported pharmaceuticals. Example: for new chemical drugs and innovative therapeutic biological products which apply for clinical trial of imported pharmaceutical products and apply for market launch of imported pharmaceutical products, the requirement for obtaining the market authorisation issued by the manufacturing country or region where the overseas pharmaceutical manufacturer is based shall be removed; and following the completion of international multi-centre drug clinical trial carried out in China, the applicant may directly apply for registration of market launch of the pharmaceutical products. The Announcement takes effect as of the date of promulgation.

Announcement of the Quanzhou Customs on the Extension and Alteration of Customs Area Code


The Quanzhou Customs released the Announcement of the Quanzhou Customs on the Extension and Alteration of Customs Area Code on 30 October 2017 and determined to formally adopt the Customs Area Code of “3726” and alter the Customs Area Code of “3718” from 30 October 2017 in accordance with the requirements set forth in the Letter of the Supervision Division in Reply on the Approval of Customs Area Code Extension and Alteration (Regulatory Letter〔2017〕No. 346). The Customs Area Code of “3726” represents for “Section of Supervision for Dry Port of Jinjiang Office of the Quanzhou Customs “and is called “Quanzhou Dry Port “for short. The Customs Area Code of “3718” is now known as “Integrated Bonded Zone of Quanzhou” and is called “Quan Zong Bao Qu” in Pinyin for short.

Announcement of the Shenzhen Customs on Unfolding of Cross-Border E-commerce Retail Importation under Online Bonded Business Model(Shenzhen Customs Announcements [2017] No. 4)


In accordance with the requirements under the Customs Law of the People’s Republic of China and the relevant policies of the State, the Notice of the Ministry of Finance, the General Administration of Customs and the State Administration of Taxation on the Taxation Policies for Cross-Border E-commerce Retail Imports (Cai Guan Shui [2016] No.18), and the Announcement from the General Administration of Customs on the Supervision and Management of Cross-Border E-commerce Retail Imports and Exports ([2016] No.26), the Shenzhen Customs has promulgated the Announcement of the Shenzhen Customs on Unfolding of Cross-Border E-commerce Retail Importation under Online Bond Model on 18 October 2017, which has set forth detailed provisions for the supervision and management of areas and enterprises conducting online bonded importation, in order to promote healthy and orderly development of cross-border E-commerce.

Announcements of the Kunming Customs of the People’s Republic of China(Kunming Customs Announcements [2017] No. 2, No. 3 and No. 4)


The Kunming Customs announced the Kunming Customs Announcements [2017] No. 2, No. 3 and No. 4 on 23 October 2017. The Announcement No. 2 has set out the requirements on matters related to the “self-transport within region” operating model of bonded goods transfer conducted by enterprises in customs special surveillance areas and bonded logistics centres within Yunnan province. The Announcement No. 3 laid down the foundation of matters relevant to the bayonet intelligent management of entry-exit border (area) goods in customs special surveillance areas and bonded supervision areas within Yunnan province. And the Announcement No. 4 has prescribed requirements on matters related to the “entering before declaration” operating model of enter-area foreign goods conducted in customs special surveillance areas and bonded supervision areas within Yunnan province. The aforesaid announcement shall be implemented with effect from the date of promulgation.
