UPC’s Milan Central Division became officially operational on June 27

On June 27, one year after the UPC Administrative Committee’s official announcement, the UPC’s Milan Central Division became officially operational. The new seat, which will flank the Paris and Munich Central Divisions operational as of June 2023, will oversee disputes relating to patents falling under category A of the International Patent Classification (IPC). This includes not only pharmaceutical patents, which are undoubtedly important, but also patents in the medical, agricultural, fashion, sports, veterinary and household goods sectors. This broad spectrum of expertise will offer Italy a unique opportunity to establish itself as a point of reference for patent litigation in several important industrial sectors. The panel of judges for the Milan section includes Presiding Judge Mr Andrea Postiglione and Judges Ms Anna-Lena Klein and Ms Marije Knijff.

6月27日，在UPC行政委员会决定设立新中央分庭相关决议一周年之际，UPC米兰中央分庭正式投入运营。据悉，UPC米兰中央分庭将与2023年6月投入运营的巴黎和慕尼黑中央分庭一同负责处理属于国际专利分类（IPC）A类的专利纠纷。其中包括重要的制药专利，还包括医疗、农业、时尚、体育、兽医和家居用品等领域的专利。米兰中央分庭的运营将为意大利提供全新的契机，使其在多个重要工业领域的专利诉讼方面发挥指引作用。新设立的米兰中央分庭选任的三名法官分别是：Andrea Postiglione（首席法官）、Anna-Lena Klein和 Marije Knijff。

The IP5 Heads of Office Meeting was held in Seoul, South Korea from June 17 to 20, during which a joint statement committing to achieve the United Nations' Sustainable Development Goals (SDGs) through enhanced intellectual property cooperation was issued. The meeting, themed "Inclusive IP Systems for Sustainable Innovation" focused on supporting the growth of innovative small and medium-sized enterprises and developing a user-friendly intellectual property system. Participants also discussed progress on the "international patent transfer" project and the "new technology and artificial intelligence roadmap," and presented research findings on "legal and precedent trends regarding the recognition of artificial intelligence as an inventor".

Malaysia seeks to secure a "patent" for its Mao Shan Wang durians

马来西亚计划为其猫山王榴莲申请“专利”

Malaysia's Agriculture and Food Security Ministry plans to "patent" the popular Mao Shan Wang durian variety due to its increasing overseas popularity, especially in China. Agriculture Minister Mohamad Sabu emphasized the need for recognition of Musang King as a Malaysian product. The Agriculture Department and its international trade unit will lead the patenting efforts. Malaysia will soon start exporting fresh durians to China, following memorandums signed during Chinese Premier Li Qiang's visit to Putrajaya. Previously, only durian paste, pulp, and frozen whole durians were exported. The ministry will oversee quality compliance for fresh shipments. In 2022, Malaysia exported RM1.14 billion (approximately 1.75 billion RMB) worth of durians, primarily to China.

YouTube in talks with record labels to train AI with copyrighted songs

YouTube is negotiating with multiple record labels to use copyrighted songs for training its AI tools. According to news released on Friday, YouTube aims to release several new AI features by the end of this year. YouTube is in discussions with Sony, Warner, and Universal, offering lump sums to license their songs. The deal would allow YouTube to use these songs to train its AI models and generate similar-style music. However, artists are reportedly concerned that such deals might undermine their talent and impact their careers. Ultimately, YouTube might not get a blanket license but access to songs from select artists who agree to the deal. An unnamed executive from a large music company mentioned, "The industry is wrestling with this. Technically the companies have the copyrights, but we have to think through how to play it."

The National Football League(NFL) must pay more than $4.7 billion in class-action damages for overcharging subscribers of its " Sunday Ticket " telecasts, a California federal jury said on Thursday. Jurors in Los Angeles agreed with the plaintiffs that the NFL conspired with member teams to artificially inflate the price of "Sunday Ticket" for millions of residential and commercial subscribers. The jury awarded $4.6 billion to a residential class, and $96 million to commercial subscribers such as bars and restaurants, according to an attorney for the plaintiffs. A judge could award triple damages under U.S. antitrust law, bringing the total judgment to more than $14 billion.

Korean e-commerce giant Coupang to confront trademark infringement on AliExpress

According to news released on June 21, Coupang, South Korea’s largest e-commerce platform, recently announced that vendors on AliExpress, the Chinese online retail service, used its brand and imagery, including its recognizable rocket delivery logo, without authorization. Coupang alleged that the vendors had infringed on its trademark and copyright and would take relevant legal actions against the infringement. Industry sources revealed that on June 20, numerous products listed on the Korean-language AliExpress website claim to be directly imported and sold via Coupang’s expedited " Rocket Delivery " service. Coupang said that these vendors, third-party merchants operating on the AliExpress platform, are not officially affiliated with Coupang. The product listings prominently display Coupang’s rocket logo, accompanied by captions stating " Coupang imported this directly " in an apparent attempt to leverage the company’s reputation for fast shipping within South Korea. In response, Coupang intended to take aggressive legal measures against these intellectual property violations.

Britain's competition regulator said last Wednesday it was investigating whether Hewlett Packard Enterprise's planned $14 billion acquisition of Juniper Networks would result in competition concerns in the country. The Competition and Markets Authority has until Aug. 14 to decide whether it would refer the deal for a deeper probe. Hewlett Packard Enterprise, or HPE, said in January it would buy networking gear maker Juniper to enhance its artificial intelligence (AI) offerings. HPE expects to close the deal by the end of 2024 or early next year as it works with the UK regulator to complete necessary reviews and secure clearance as soon as possible, the company said in an email.

Microsoft hit with EU antitrust charge, facing fine of 10% of its global annual turnover

The European Commission on Tuesday accused Microsoft of illegally linking its chat and video app Teams with its Office product, giving it an unfair advantage over rivals such as Slack. Microsoft faces a hefty antitrust fine. The European Commission's latest action was triggered by a 2020 complaint from Slack. The European Commission said Teams had been given a distribution advantage while limitations preventing interaction between Teams' competitors and Microsoft's offerings further hindered rivals. The U.S. tech giant had reportedly to pay 2.2 billion euros in EU antitrust fines two decades ago for bundling two or more products together and other offences. It risks a fine of as much as 10% of its global annual turnover if it is found guilty of latest alleged antitrust breaches.
