【周一干正事】讲座推荐：第三国参加制度与国际法院俄乌案

俄乌案最新发展，以国际法院参加程序为背景。

《国际法院规约》第63条规定了第三国诉讼参加制度。根据该条规定，某一国家如认为某案件之判决可影响属于该国具有法律性质之利益时，得向法院声请参加。2022年7月21日至28日期间，拉脱维亚、立陶宛和新西兰试图通过启动《国际法院规约》下第三国参加程序加入俄乌案。(Allegations of Genocide under the Convention on the Prevention and Punishment of the Crime of Genocide (Ukraine v. Russian Federation)) 同一周，国际法院也确定了其对冈比亚诉缅甸案的管辖权（The Gambia v. Myanmar）。该案中也涉及到第三国参加程序。这些发展表明时下正是讨论第三国参加制度的良好契机。
