互联网技术的发展引发了人类社会生活的深刻变革,也给全球法治带来了巨大的挑战和机遇。在世界范围内,对互联网的法律规制都已成为公共政策制定和法学学术研究的热点议题。各国基于不同的规制理念,采取不同的规制工具,形成了不同的互联网规制体系。
Frontiers of Law in China
(《中国法学前沿》)第13卷第3期特推出专辑“
欧盟与中国的互联网规制范式
”,约请中国人民大学法学院和慕尼黑大学法学院学者撰文,对中国和欧盟的互联网规制制度与理论进行比较研究,以期全面展现互联网规制的光谱,在规制过度—规制不足、政府规制—自我规制之间等不同模式之间寻求平衡与创新,在各自宪法和政治秩序框架内共同探索更为科学有效的互联网法律规制范式。
本期专辑特邀中德双方知名学者王轶教授和Christian Walter教授撰写序言,韩大元教授和Dieter Grimm教授撰写学术导言,还包括1篇编者话和9篇研究性论文。编者话对中国和欧盟的互联网规制理念和模式进行了整体介绍,9篇研究性论文则从不同角度对中欧互联网规制中的具体问题进行了深入探讨,内容涵盖互联网内容管控、互联网平台责任、网络服务提供者的刑事责任、物联网中的数据规制、个人数据保护、网约车规制、空间作为互联网规制的范式、数字边境管控以及互联网中的基本权利保护等多个方面。
